FieldTripHQ Terms of Service

Last updated: September 15, 2026

Draft for review. Tailored starting terms for FieldTripHQ. The liability cap amount, dispute-resolution mechanics, and any international/regional addenda still need review by Florida counsel experienced in education software before these are treated as final. Not legal advice.

These Terms govern your use of FieldTripHQ ("the app", "the Services"), operated by SKATTIC LLC ("we", "us"). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the app. In these Terms, "you" means the person or the organization using the Services; where you act for a school or organization, "you" includes that organization (see "Acting on behalf of a school or organization").

Who may use it

You must be an adult (or otherwise legally able to enter this agreement) to create an organizer account. You are responsible for the activity under your account and for keeping your login secure.

Acting on behalf of a school or organization

If you accept these Terms on behalf of a school, district, or other organization, you represent that you have the authority to bind that organization. Where a school relies on FERPA's school-official exception, we act under the school's direction with respect to the education records it controls.

How trips are owned, and what deletion does. Today, each trip is owned by the individual account that creates it. You can invite co-editors and coordinators to help run a trip, but they have delegated access only — the owning account controls the trip. If the owning account is deleted, the trip and its records are deleted with it, even where helpers were invited and even if the organization considers the records its own. We do not yet offer automatic organization-level ownership or self-service ownership transfer. If your school needs a trip's records to persist independently of an individual's account — for example, when a staff member leaves — you must arrange an ownership transfer with us before that account is deleted; contact us to set one up. Do not assume records are preserved automatically.

Your responsibilities with trip data

Organizers enter information about the people on a trip, including minors. You represent that you have the authority and any consent required to enter that information, and that you will use it only to run the trip. You are responsible for the accuracy of what you enter and for handling health, contact, and other sensitive details appropriately (for example, sharing them only with authorized staff).

AI-assisted features

The app offers optional AI-assisted import and form-building. These features may produce inaccurate or incomplete results. You must verify AI output against the original source before saving or relying on it. Appropriately qualified and authorized personnel must verify medication names, dosages, instructions, allergies, and other health information against authoritative records. AI output is not medical advice and must not independently determine or change any treatment or care decision.

Trip safety and the limits of this tool

FieldTripHQ is an administrative and organizational tool. It is not an emergency-response, supervision, headcount, or student-location verification system. Organizers and the organizing school or group remain responsible for participant safety, including supervision, headcounts, transportation and pickup authorization, permission slips and emergency-treatment authorizations, verification of itineraries, bookings, and travel documents, and emergency communication. You must maintain appropriate backup procedures and independent access to critical trip and emergency information for times when the Services are slow, offline, or otherwise unavailable. These Terms and anything in the app do not replace a school's own permission forms, waivers, or trip-specific approvals.

Acceptable use

Do not use the app to break the law, infringe others' rights, upload harmful or unauthorized content, attempt to access data that is not yours, or disrupt the service. We may suspend or terminate accounts that violate these Terms.

Payments

Some features may require payment. Prices, what they include, and whether a charge is one-time or recurring are shown before you pay. Payments are processed by our payment provider (Stripe). Purchases of digital features are handled through the web, not through in-app purchase. Fees are non-refundable except where required by law or expressly stated. If we discontinue a paid feature you have prepaid for, we will provide a pro-rated refund for the unused, prepaid portion. Any collection of trip money from families is arranged and controlled by the organizer, who is responsible for their own refund and cancellation terms with those families.

Content and ownership

You keep ownership of the content and data you upload. You grant us the limited rights needed to store and display it in order to provide the service. The app itself, including its software, design, and branding, remains the property of SKATTIC LLC.

Availability and changes

We work to keep the app available but do not guarantee uninterrupted service. We may update, change, or discontinue features. We may update these Terms; for material changes we will provide reasonable notice (for example, by email or an in-app notice), and continued use after a change takes effect means you accept the updated Terms.

Disclaimers and liability

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. The app is an organizational tool, and responsibility for the trip and the people on it remains with the organizing school or group.

To the fullest extent permitted by law, SKATTIC LLC will not be liable for indirect, incidental, special, consequential, or punitive damages. Except for liabilities that cannot be limited by law, our total aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amounts you paid us for the Services in the twelve months before the event giving rise to the claim, or (b) US $100. For this cap, "amounts you paid us" means the subscription or feature fees you paid SKATTIC for the Services; it does not include registration or trip money collected from families, which is the organizer's money passing through the payment processor and is never a fee to us. This section does not exclude or limit any rights you have under mandatory consumer-protection or other laws that cannot be waived, and those rights continue to apply where required. (The cap amount and any carve-outs — for example for breaches of confidentiality or data-security obligations — are subject to counsel review before these Terms are final.)

Indemnity

To the extent permitted by law (and subject to any restrictions applicable to public schools or government entities), you agree to indemnify SKATTIC LLC against third-party claims arising from your unlawful or unauthorized uploads, your violation of these Terms, or your misuse of the Services. This does not apply to claims caused by SKATTIC's own violation of these Terms or its own negligence or misconduct. If we seek indemnity, we will notify you promptly of the claim, let you control its defense with counsel of your choice, and cooperate reasonably; you may not settle a claim in a way that imposes any obligation or admission on us without our prior written consent.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Miami-Dade County, Florida (including the U.S. District Court for the Southern District of Florida), and you consent to their jurisdiction — except where mandatory consumer-protection law grants you a different forum, in which case that law controls. Nothing in these Terms waives mandatory consumer protections or data-protection rights available to you under the law of your home country. Where FieldTripHQ is used outside the United States, or by a school that requires one, a separate data processing addendum and any required regional terms apply and are available on request.

Termination

You may stop using the app and delete your account at any time (Account → Delete account); note that this removes your login and the data you own, but not records controlled by a school or organization (see "Acting on behalf of a school or organization"). We may suspend or end access for violations of these Terms.

General

If any provision of these Terms is held unenforceable, the rest remain in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver of it. The sections on data responsibilities, disclaimers, liability, indemnity, and governing law survive termination. Where SKATTIC LLC and a school or organization have signed a separate written agreement covering the Services, that agreement controls over these Terms to the extent of any conflict. Notices to us may be sent to the contact address below.
